Forced share, quarta falcídia and legacies

We support and represent heirs and legatees in defending their inheritance rights, both out of court and in court.

We advise on:

  • Claiming the forced share (legítima): advice and representation for forced heirs claiming the part of the estate that the law reserves for them, even when the will provides otherwise.
  • Applying the quarta falcídia: legal support for heirs when the legacies exceed the legal limits, so that they receive at least a quarter of the estate, as the law provides.
  • Enforcing and defending legacies: assistance for heirs and legatees in disputes over legacies, ensuring that the testator’s wishes are properly carried out and that the rights of those involved are protected.

Before bringing any claim, we carry out a detailed study of the inheritance, review the documents (will, declaration of heirs, title deeds, inventory of assets, etc.) and assess the legal options available to decide on the best strategy.
